Establishes the Alzheimer's Disease
Research Special Plate and Fund and modifies the administration of the
Prevention of Child Abuse Fund.
History
The Arizona Department of Transportation (ADOT) is required to issue or renew special license plates in lieu of regular license plates under specified conditions and procedures (A.R.S. § 28-2403). A $25 fee is required for each original and each annual renewal of special plates, with some exceptions (A.R.S. § 28-2402). Special license plates currently being offered include Arizona State University, Purple Heart, Child Abuse Prevention and Historic Plate. ADOT currently offers over 60 special license plates.
Laws 1999, Chapter 71 § 8 established the Child Abuse Prevention Special Plate and Prevention of Child Abuse Fund. The standard $25 special plate fee applies, where $8 is an administrative fee and $17 is an annual donation to the Fund. The Fund is required to be administered by the Director of the Division for Children in the Governor's Office. Monies in the Fund must be allocated through a private foundation that is a qualified charity which matches all or a portion of allocated monies. The private foundation must further allocate the monies to primary prevention programs that strengthen families and increase both public and professional awareness to prevent child abuse in all its forms to children in Arizona (A.R.S § 41-109).
Provisions
Alzheimer's Disease Research Special Plate and Fund (Sec. 3, 8)
1. Directs ADOT to issue the Alzheimer's Disease Research Special Plate, if by December 31, 2019 a person pays $32,000 for implementation.
2. Requires the person who paid the $32,000 to design the Plate, subject to ADOT approval.
4. Establishes the Alzheimer's Disease Research Fund, administered by the Director of the Department of Health Services (DHS).
5. Requires that, of the $25 fee required to obtain and renew a special plate, $8 is an administrative fee and $17 is an annual donation.
6. Requires that the $8 administration fee be deposited into the State Highway Fund and the $17 annual donation be deposited into the Fund.
7. Requires the first $32,000 in the Fund to be reimbursed to the person who paid the implementation fee.
8. Requires no more than 10% of monies deposited annually in the Alzheimer's Disease Research Fund to be used for administering of the Fund.
9. States that monies in the Fund are continuously appropriated.
10. Requires the Director of DHS to annually allocate monies in the Fund, excluding administrative fees, to a charitable organization that meets all of the following:
a. Is headquartered in Arizona;
b. Has been operating in Arizona for at least ten years;
c. Has participating member institutions that work to end Alzheimer's disease by utilizing complementary strengths in brain imaging, computer science, genomics, basic and cognitive neurosciences and clinical and neuropathology research within a statewide model; and
d. Has member institutions that educate residents of Arizona about Alzheimer's disease, research progress and resources needed to help patients, families and professionals manage the disease.
11. States that monies in the Fund are non-lapsing appropriations.
The Prevention of Child Abuse Fund (Sec. 9)
12. States that the Director of the Governor's Office of Youth, Faith and Family will administer the Prevention of Child Abuse Fund.
13. Removes the requirement to allocate monies through a private charitable foundation that guarantees matching all or a portion of allocated monies.
14. Requires the monies in the Fund to be allocated to primary prevention programs that strengthen families and prevent child abuse in all forms, rather than to only programs that increase public and professional awareness.
15. Eliminates the requirement to forward all monies in the Fund to the specified private charitable foundation.
16. Allows, beginning January 1, 2020, monies in the Fund be allocated to child and family advocacy centers to provide support to victims of child abuse.
17. Eliminates the application requirement for allocation of monies.
18. Removes the definitions of donation and person.
