Purpose
An emergency measure that requires the Department of Health Services (DHS) to share with the Arizona Department of Revenue (ADOR) sales data collected from registered nonprofit medical marijuana dispensaries. Contains requirements for enactment for initiatives and referendums (Proposition 105).
Background
The Arizona Medical Marijuana Act was passed as a 2010 ballot measure, legalizing the use of medical marijuana. Current requirements for nonprofit medical marijuana dispensaries focus on security measures, cultivation, acquisition and consumption on the dispensary's premises (A.R.S. § 36-2806).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires DHS to share with ADOR sales data collected from registered nonprofit medical marijuana dispensaries.
2. Excludes the sharing of any registered qualifying patient-specific information.
3. Requires DHS to revoke the registration of nonprofit medical marijuana dispensaries that do not comply with transaction privilege tax requirements.
4. Makes technical changes.
5. Requires for enactment the affirmative vote of at least three-fourths of the members of each house of the Legislature (Proposition 105).
6. Becomes effective on signature of the Governor, if the emergency clause is enacted.
