Purpose
Specifies that any fraction or portion of a 24-hour period, from midnight to midnight, is considered the first day of a time period in which an act is required to be completed.
Background
Current statute requires that the time in which an act is required to be completed will be recorded by excluding the first day and including the last day of a given time frame, unless the last day is a holiday, in which case it is also excluded. When Arizona, a state agency or any other political subdivision must give notice of a decision, the entity must give it to a petitioner who will then have no less than 10 days to file. The time shall start the day after the day the petitioner receives the decision by personal service, registration or certified mail (A.R.S. § 1‑243).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Specifies that any fraction or portion of a 24-hour period, from midnight to midnight, constitutes the first day when computing the period in which an act is required to be completed.
2. Makes technical changes.
3. Becomes effective on the general effective date.
