FACT SHEET FOR S.B. 1153

 

vehicle towing storage fees

Purpose

            Adjusts the daily storage fee relating to the release of an impounded vehicle.

Background

            Statute requires a vehicle that is removed and either immobilized or impounded by a law enforcement officer to be impounded for 30 days (A.R.S. § 28-3511). An immobilizing or impounding agency releases the vehicle before the 30 days if certain criteria are met by the registered owner, owner's agent or the motor vehicle dealer that owns the vehicle. Statute requires the storage fee an impounding agency to charge $15 for each day the vehicle is in storage (A.R.S. § 28-3512).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Adjusts the $15 a day storage fee assessed upon the release of an impounded vehicle to reflect the average change in the Phoenix Consumer Price Index between 2004 and 2019.

2.      Modifies the fee annually based on the average change in the Phoenix Consumer Price Index.

3.      Makes technical changes.

4.      Becomes effective on the general effective date.
