marijuana dispensaries; inspections; business hours
Purpose
Allows the Department of Health Services (DHS) to inspect medical marijuana dispensaries (dispensaries) during business hours without providing prior notice. Contains requirements for enactment for initiatives and referendums (Proposition 105).
Background
The Medical Marijuana Act, proposed by initiative petition and approved by voters in the 2010 general election, allows qualifying patients and designated caregivers to receive medical marijuana and allows dispensaries to dispense, acquire, cultivate, prepare and transport medical marijuana. Dispensaries are required to register with DHS and are also subject to reasonable inspection by DHS. Currently, DHS must provide notice prior to inspecting a dispensary (A.R.S. §§ 36-2804 and 36-2806).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Permits DHS to inspect dispensaries during normal business hours and removes the requirement that DHS provide notice prior to inspection.
2. Makes technical changes.
3. Requires for enactment, the affirmative vote of at least three-fourths of the members of each house of the Legislature (Proposition 105).
4. Becomes effective on the general effective date.
