Purpose
Establishes the office of Lieutenant Governor and places the Lieutenant Governor as the Director of the Arizona Department of Administration (ADOA).
Background
Statute states that the
Director of the ADOA (Director) shall: 1) direct, control and operate the ADOA;
2) provide assistance to the Governor and Legislature; 3) adopt rules,
policies, plans and programs; 5) employ and determine the conditions of
employment; 6) make contracts and incur obligations subject to the availability
of monies; 7) assist other departments, agencies and institutions of the state,
local and federal government; 8) accept and disburse monies for the conduct of
programs; 9) establish and maintain separate financial accounts as required by
law;
10) advise and make recommendations to the Governor and the Legislature; and
11) delegate the administrative functions, duties and powers to carry out the
efficient operation of the ADOA. The Director must execute each duty in the
furtherance of the overall purposes and objectives of the ADOA (A.R.S.
§ 41-703).
The Constitution of Arizona states that in order to be eligible for election to an office of the Executive Department, a person must be at least 25 years of age, a citizen of the United States for 10 years next preceding the election and a citizen of Arizona for 5 years next preceding the election (Ariz. Const. art. 5 § 2).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires, at least 60 days before the date of the general election, a candidate for Governor to submit to the Secretary of State the name of the person who is the joint candidate for Lieutenant Governor with that gubernatorial candidate.
2. Directs a candidate for Lieutenant Governor to appear as the joint candidate of a candidate for Governor on the general election ballot.
3. Establishes the Lieutenant Governor as the Director.
4. Requires Legislative Council staff to prepare conforming legislation to the provisions of this act for consideration in the 55th Legislature, 1st Regular Session.
5. Conditions the enactment of this legislation on passage of S.C.R. 1008, 54th Legislature, 1st Regular Session by a vote of the people at the next general election.
6. Makes technical and conforming changes.
7. Becomes effective on the general effective date or later, subject to the provisions of the conditional enactment.
