mining; definition

Purpose

            Includes activities on off-site infrastructure in the definition of mining and expands the mining activities included in regulation of mining.

Background

Title 27, Chapter 3, Arizona Revised Statutes, regulates the operation of mines in the state including all lands containing excavations, underground passageways, shafts, tunnels and workings, structures, facilities, equipment, machines or other property including impoundments, retention dams, tailings and waste dumps, on the surface or underground, used in, to be used in or resulting from the work of extracting minerals or other materials, excluding hydrocarbons. 

             Current statute defines mining as the activities conducted to develop or extract materials from a mine including on-site transportation, concentrating, milling, leaching, smelting or other processing of ores or other materials, including mind land reclamation activities (A.R.S.  27-301).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Adds to the definition of mining:

a)      activities conducted to explore materials from a mine;

b)      storing materials from a mine; and

c)      activities on off-site infrastructure such as power, water, fiber-optic and other communications services and construction facilities activities.

2.      Makes technical and conforming changes.

3.      Becomes effective on the general effective date.
