FACT SHEET FOR H.B. 2070

(NOW: adult behavioral health therapeutic home)

Purpose

            Exempts adult behavioral health therapeutic homes from physical plant and zoning standards prescribed for health care institutions.

Background

            The Department of Health Services (DHS) is generally responsible for the licensure, regulation and inspection of health care institutions in Arizona. A health care institution is a place or institution, that provides facilities with medical services, nursing services, behavioral health services, health screening services, other health-related services, supervisory care services, personal care services or direct care services and includes home health agencies, outdoor behavioral health care programs and hospice service agencies.  License applications for health care institutions are required to include architectural plans and specifications that meet minimum licensure standards specified within the health care institution's class or subclass, including physical plant and zoning standards prescribed by DHS (A.R.S. §§ 36-401 and 36-421; A.A.C. R9-1-412).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Defines adult behavioral therapeutic home as a residence for individuals who are at least 18 years old, have behavioral health issues and need behavioral services that:

a)      provide room and board;

b)      assist in acquiring daily living skills;

c)      coordinate transportation to scheduled appointments;

d)      monitor behaviors;

e)      assist in the self-administration of medication; and

f)       provide feedback to case managers related to behavior.

2.      Exempts adult behavioral health therapeutic homes from compliance with physical plant and zoning standards for a health care institution as prescribed by DHS.

3.      Makes conforming changes.

4.      Becomes effective on the general effective date.
