personal mobile cargo carrying devices
Purpose
Defines personal mobile cargo carrying device and allows the operation of such devices on sidewalks.
Background
Current statute prohibits a person from driving a vehicle on a sidewalk, except this prohibition does not apply to motorized wheelchairs, electric personal assistive mobility devices, personal delivery devices, authorized emergency vehicles or a security vehicle or small service vehicle owned by the state (A.R.S. § 28-904).
Laws 2018, Chapter 306 defined personal delivery devices and established rules and regulations regarding the operation of these devices on sidewalks and crosswalks. A personal delivery device is an electronically powered device that: 1) is operated primarily on sidewalks and within crosswalks; 2) weighs less than 200 pounds, excluding cargo; 3) has a maximum speed of 7 miles per hour; 4) can be operated with or without active control of a natural person; 5) and is equipped with a braking system.
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Allows the operation of a personal mobile cargo carrying device on a sidewalk.
2. Defines a personal mobile cargo carrying device as an electronically powered device that:
a) is operated primarily on sidewalks and within crosswalks and that is designed to transport property;
b) weighs less than 80 pounds, excluding cargo;
c) operates at a maximum speed of 12 miles per hour;
d) is equipped with technology to transport personal property with the active monitoring of a property owner and that is primarily designed to remain within 25 feet of the property owner; and
e) is equipped with a braking system that when active or engaged enables the personal mobile cargo carrying device to come to a controlled stop.
3. States that a person operating a personal mobile cargo carrying device is subject to all the same rights and duties related to traffic and vehicle regulation, driving under the influence and penalties for vehicle violations, unless the provisions by their nature have no application.
4. Excludes personal mobile cargo carrying device from the definitions of motor vehicle, vehicle and personal delivery device.
5. Makes technical and conforming changes.
6. Becomes effective on the general effective date.
