FACT SHEET FOR H.B. 2181

 

registrar of contractors; licensing; exemption

Purpose

            Exempts cable television, satellite television and telecommunications providers from Registrar of Contractors (ROC) licensure requirements.

Background

            The ROC’s responsibilities include: 1) classifying and qualifying applicants for licensure; 2) establishing written examinations; and 3) conducting investigations (A.R.S. § 32‑1122). Current statute exempts certain individuals from ROC licensure. These exemptions include: 1) public utilities regulated by the Arizona Corporation Commission; 2) any materialman, manufacturer or retailer who furnishes work of $1,000 or less excluding any electrical fixture or appliance that can be plugged into a common household electrical outlet using a two-pronged or three-pronged electrical connector; 3) property owners who complete work on their property themselves, with their employees or with duly licensed contractors; and 4) the sale or installation of finished products, materials or articles of merchandise that are not fabricated into a permanent part of a structure (A.R.S. § 32-1121).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Exempts, from ROC licensure, cable television, satellite television and telecommunications providers, including data and related services and contractors and subcontractors, if the work is limited to installing low-voltage cable, telephone services, internet services and data service.

2.      Specifies that installation does not include digging, trenching, grading, horizontal boring, compacting or filling earthen or other material before the service drop of a commercial or residential structure.

3.      Excludes, from the total value of a sales contract or transaction, any electrical fixture or appliance that has internal batteries that do not exceed 12 volts in a single, series or parallel configuration when determining licensure exemptions based on project cost.

4.      Makes technical changes.

5.      Becomes effective on the general effective date.
