Purpose
Allows a youth who resides with and is under the guardianship of an Arizona resident to obtain a resident game and fish license, permit, tag or stamp.
Background
Current statute defines resident as: 1) a member of the armed forces of the United States who is stationed in the state for a period of thirty days preceding the date of applying for the license, permit, tag or stamp, or is stationed in another state or country but who lists Arizona as the person's home; or 2) a person who is domiciled in the state for six months immediately preceding the date of applying for a license, permit, tag or stamp and who does not claim residency privileges in any other state or jurisdiction (A.R.S. § 17-101).
Current statute requires a person to obtain a license to take, handle or possess wildlife (A.R.S. § 17-101). Statute authorizes the Arizona Game and Fish Commission (Commission) to adopt rules and regulations and issue licenses for the personal use and possession of wildlife (A.R.S. § 17-238). According to the rules set by the Commission, fees for the licenses, permits, tags and stamps vary depending on the type of species and if the applicant is an Arizona resident or if the applicant is a youth. Some exceptions apply to youth-only hunts. Hunt permit-tags are only obtained through application and drawing procedures. A person may purchase nonpermit‑tags at Arizona Game and Fish Department offices or licensed dealers (A.A.C. Title 12, Chapter 4).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Includes a youth who resides with and is under the guardianship of a resident in the definition of resident for the purposes of applying for hunting or fishing licenses, hunting permit-tags, nonpermit-tags or for a migratory bird or federal waterfowl stamp.
2. Makes technical and conforming changes.
3. Becomes effective on the general effective date.
