industrial hemp; licensing; effective date.
Purpose
An emergency measure that requires the Arizona Department of Agriculture (AZDA) to adopt the initial rules for regulating industrial hemp by May 31, 2019.
Background
Industrial hemp is the plant cannabis sativa L. and any part of such plant whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than three-tenths percent on a dry-weight basis (A.R.S. § 3-311).
Laws 2018, Chapter 287 created the Industrial Hemp Program (Program) administrated by the AZDA, effective by August 3, 2019. The Program includes agricultural pilot programs for propagation, processing, manufacturing, distribution and market research related to industrial hemp. An agricultural pilot program is designed to research the growth, cultivation and marketing of industrial hemp, hemp seeds and hemp products (A.R.S. § 3-311). The legislation authorizes the AZDA to adopt rules for the Program and exempts the AZDA from rulemaking requirements for this purpose through August 3, 2019.
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires the AZDA to adopt the initial rules for the licensing, production and management of industrial hemp by May 31, 2019.
2. Makes industrial hemp regulation effective on June 1, 2019.
3. Makes technical and conforming changes.
4. Becomes effective on signature of the Governor, if the emergency clause is enacted.
