SUBJECT:      Strike everything amendment to H.B. 2361, relating to tourism; sporting event; promotion; marketing


 


Purpose

Exempts the Arizona Office of Tourism (AOT) from statutory procurement requirements for a specified event.

Background

The Arizona Procurement Code regulates the buying, purchasing, renting, leasing and acquiring of materials, services and construction services using public monies (A.R.S. Title 41, Chapter 23). The Arizona Procurement Code applies to every expenditure of public monies by Arizona through a state government unit with outlined exceptions (A.R.S. § 41-2501). Current law requires the State Treasurer to appropriate $1,500,000 per fiscal year to the the AOT for the promotion and marketing of a special sporting event at a host facility if the special sporting event project cost incurred after December 31, 2016, is at least $100,000,000 (A.R.S. § 41-2308).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Exempts the AOT from the Arizona Procurement Code requirements for promotion and marketing contracts for a special sporting event at a host facility.

2.      Requires the AOT to contract with a promotion and marketing agency which is approved by the host facility.

3.      Allows the AOT to contract with a promotion and marketing agency that is not awarded a statewide marketing contract.

4.      Makes technical changes.

5.      Becomes effective on the general effective date.

Amendments Adopted by Committee

1.      Adopted the strike-everything amendment.

2.      Adds language requiring the AOT to contract with a promotion and marketing agency that is approved by the host facility and allows the AOT to contract with an agency that is not awarded a statewide marketing contract.

3.      Makes technical changes.
