FACT SHEET FOR H.B. 2495

 

appropriations; named claimants

Purpose

            Appropriates monies from various funds to named claimants in FY 2019.

Background

            When monetary claims are made against the state, the Director of the Arizona Department of Administration (ADOA) has limited authority to approve payments to claimants, provided that claimants meet statutorily-defined timelines and that sufficient monies are available to pay the approved claims. Claims that are more than one fiscal year old and less than four fiscal years old must be presented by the ADOA to the Legislature to request appropriations sufficient for payment of the claims (A.R.S. § 35-191).

            H.B. 2495 appropriates $306,210.37 from the state General Fund (GF) and $298,624.19 from other funds in FY 2019.

Provisions

1.      Appropriates monies from the state GF as follows:

a)      $541.62 to the ADOA;

b)      $76,588.93 to the Arizona Department of Corrections; and

c)      $8,000 to the Arizona Department of Juvenile Corrections.

2.      Appropriates monies to the Department of Public Safety (DPS) for the payment of claims by the Arizona Department of Revenue as follows:

a)      $221,079.82 from the state GF;

b)      $19,378.39 from the Arizona Highway Patrol Fund;

c)      $2,298.91 from the Criminal Justice Enhancement Fund; and

d)      $264,145.12 from the DPS Forensics Fund.

3.      Appropriates $11,887.37 to pay claims made against the ADOA, to the ADOA from the Capital Outlay Stabilization Fund.

4.      Appropriates $427.68 to pay claims made against the ADOA, to the ADOA from the Risk Management Revolving Fund.

5.      Appropriates $486.72 to pay claims made against the ADOA, to the Arizona Department of Transportation from the State Highway Fund.

6.      Requires the ADOA to coordinate payment of claims.

7.      Becomes effective on the general effective date, retroactive to June 1, 2019.
