CTEDs; nonprofits; private postsecondary institutions
Purpose
Allows nonprofit organizations or postsecondary institutions to form partnerships and establish agreements with career technical education districts (CTEDs).
Background
CTEDs are specialized school districts designed to deliver career and technical education course offerings to secondary students in cooperation with school districts and charter schools.
A CTED governing board (CTED board) manages and controls a CTED. Current statute allows a CTED board and a community college district to establish agreements for administrative, operational and educational services and facilities. Any agreement between the CTED board, a school district, a charter school, a community college district or another CTED must be an intergovernmental agreement or other written contract.
An intergovernmental agreement or other written contract must outline: 1) the financial provisions including the format for the billing of all services; 2) the accountability provisions; 3) the responsibilities of each CTED, school district, charter school and community college district that is a party to the agreement or contract; 4) the type of instruction, including individualized education programs; 5) the quality of the instruction; 6) the transportation services and the manner in which transportation costs will be paid; 7) the amount the CTED will contribute to a course and the amount of support required by the school district or the community college; 8) that the services provided by the CTED, the school district, the charter school or the community college district be proportionally calculated in the cost of delivering the service; 9) that the payment for services will not exceed the cost of the services provided; 10) that the CTED will provide professional development for teachers at a satellite campus and ongoing evaluation and support of satellite programs and courses; and 11) an itemized list of other goods and services provided to the member district (A.R.S. § 15-393).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Allows a CTED board to enter into an agreement for administrative, operational and educational services and facilities with:
a) a nonprofit organization devoted to vocational training; or
b) a public or private postsecondary institution.
2. Subjects the agreements between a CTED board and a nonprofit organization, or a public or private postsecondary institution, to the requirements of an intergovernmental agreement or other written contract between a CTED board, a school district, a charter school, a community college district or another CTED.
3. Makes technical and conforming changes.
4. Becomes effective on the general effective date.
