AN ACT

 

amending title 23, chapter 2, article 7, Arizona Revised Statutes, by adding section 23-361.03; amending title 23, chapter 2, article 8, Arizona Revised Statutes, by adding section 23-366; amending title 23, chapter 2, article 8.1, Arizona Revised Statutes, by adding section 23-382; relating to employment practices.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, title 23, chapter 2, article 7, Arizona Revised Statutes, is amended by adding section 23-361.03, to read: 

START_STATUTE23-361.03.  Exemption; liability

A.  This article does not apply to any person who is exempt from the minimum wage and maximum hours requirements under federal law pursuant to 29 United States Code section 213(a)(19).

B.  In any civil action, administrative complaint or other proceeding commenced before, on or after the effective date of this section, an employer or former employer is not subject to any liability or punishment under this article for any violation of this article with respect to any work performed before, on or after the effective date of this section by any person who is exempt from the minimum wage and maximum hours requirements under federal law pursuant to 29 United States Code section 213(a)(19). Sec. 2.  Subject to the requirements of article IV, part 1, section 1, Constitution of Arizona, title 23, chapter 2, article 8, Arizona Revised Statutes, is amended by adding section 23-366, to read:

START_STATUTE23-366.  Exemption; liability

A.  This article does not apply to any person who is exempt from the minimum wage and maximum hours requirements under federal law pursuant to 29 United States Code section 213(a)(19).

B.  In any civil action, administrative complaint or other proceeding commenced before, on or after the effective date of this section, an employer or former employer is not subject to any liability or punishment under this article for any violation of this article with respect to any work performed before, on or after the effective date of this section by any person who is exempt from the minimum wage and maximum hours requirements under federal law pursuant to 29 United States Code section 213(a)(19).END_STATUTE

Sec. 4.  Requirements for enactment; three-fourths vote

Pursuant to article IV, part 1, section 1, Constitution of Arizona, sections 23-361.03, 23-366 and 23-382, Arizona Revised Statutes, as added by this act, are effective only on the affirmative vote of at least three‑fourths of the members of each house of the legislature.
