AN ACT

 

amending title 18, chapter 3, article 1, Arizona Revised Statutes, by adding section 18-306; appropriating monies; relating to government web portals.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 18, chapter 3, article 1, Arizona Revised Statutes, is amended by adding section 18-306, to read:

START_STATUTE18-306.  Comprehensive internet web portal; business start-up information; third-party administrator

A.  Subject to legislative appropriation, the department of administration shall establish an internet web portal that serves as a streamlined application process for starting a business in this state, including:

1.  Business licensing requirements.

2.  Trademark and service mark registration requirements.

3.  Trade name registration requirements.

4.  Transaction privilege tax and municipal privilege tax license requirements.

5.  Other applicable business licensing requirements, as determined by the department.

B.  The department of administration shall coordinate and enter into agreements with the corporation commission, the department of revenue, the secretary of state, the state treasurer and other agencies, boards or commissions of this state as necessary to gather the information for, implement and operate the internet web portal.

C.  Except as provided by section 35‑315, subsection F, the department of administration shall contract with a third‑party entity to establish and administer the internet web portal and shall Select the third‑party entity pursuant to title 41, chapter 23.END_STATUTE

Sec. 2.  Comprehensive internet web portal; implementation report; delayed repeal

A.  On or before December 31 of each year through December 31, 2022, the department of administration shall submit a report to the president of the senate, the speaker of the house of representatives, the director of the joint legislative budget committee and the director of the governor's office of strategic planning and budgeting on implementing the comprehensive internet web portal described in section 18‑306, Arizona Revised Statutes, as added by this act, including  expenditures to date, deliverables, the timeline for completion and the current implementation status.

B.  This section is repealed from and after September 30, 2023.

Sec. 3.  Appropriations; department of administration; web portal; exemption

A.  The sum of $4,000,000 is appropriated from the state general fund in fiscal year 2019-2020 to the department of administration to establish and maintain the business start-up internet web portal pursuant to section 18‑306, Arizona Revised Statutes, as added by this act.

B.  The sum of $400,000 is appropriated from the state general fund in fiscal year 2020-2021 to the department of administration to maintain and operate the business start-up internet web portal pursuant to section 18-306, Arizona Revised Statutes, as added by this act.

C.  The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
