AN ACT
amending Title 41, chapter 8, article 1, Arizona Revised Statutes, by adding section 41-1306; relating to legislative council.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 41, chapter 8, article 1, Arizona Revised Statutes, is amended by adding section 41-1306, to read:
41-1306. Legislation; unconstitutional statutes; hearing
A. The director of the Arizona legislative council shall prepare proposed legislation for consideration in the regular session that repeals any statutory law that an appellate court in this state or a federal court held unconstitutional in an opinion or decision that was issued not less than ninety days before the commencement of the regular session if further judicial review by mandatory or discretionary appeal is not available or being sought.
B. Not less than eighty days before the commencement of the regular session, the director shall post on the legislature's website the proposed legislation. Within thirty days after posting the proposed legislation, a person may submit written comments on the proposed legislation to the legislative council. The legislative council shall hold a meeting before the regular session and take public testimony on the proposed legislation.
C. Not less than thirty days before the commencement of the regular session, the legislative council shall transmit to the speaker of the house of representatives and the president of the senate and post on the legislature's website:
1. The proposed legislation.
2. The written comments that were submitted to legislative council and the minutes of the legislative council meeting.
3. The legislative council's written explanation on whether and how the proposed legislation incorporates the written comments or public testimony.
D. Any legislator may introduce the proposed legislation in the legislator's respective chamber.
E. On introduction of the proposed legislation, The chief clerk of the house of representatives and the senate Secretary shall enter into the official record the written comments and legislative council's written explanation.
