Page 1, strike lines 11 through 17, insert:
"1. Specific trust language that protects the state's beneficiary interest in the trust, and that names the administration or the state medicaid agency agencies as the primary beneficiary remainder beneficiaries of the trust if the trust is terminated before or on the death of the member and that provides that on termination of the trust or on the death of the trust beneficiary any state medicaid agency that is a remainder beneficiary will receive its proportionate share of all amounts remaining in the trust equal to the total amount of medical assistance paid on behalf of the trust beneficiary under the state plan. The trust document shall state"
