AN ACT
amending Title
8, chapter 4, article 8, Arizona Revised Statutes, by adding section 8-812;
relating to child safety.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 8, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 8-812, to read:
8-812. Adopted child; severe
complex mental illness; removal; parental rights suspension
A. The department may remove a child
from the child's adoptive home and suspend the adoptive parents' parental
rights if all of the following are true:
1. The child suffers from a severe
and complex mental illness.
2. As a result of this illness, the
child poses a risk of harm to the other members of the child's family.
3. The adoptive parents consent to
the removal and the suspension of parental rights.
B. If a child is removed pursuant to
subsection A of this section, the department shall attempt to find a placement
and provide treatment to prepare the child for possible return to the child's
adoptive home and to allow restoration of the adoptive parents' parental
rights.
