AN ACT
Amending title 38, chapter 8, Arizona Revised Statutes, by adding article 3; appropriating monies; relating to supplemental benefits.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 38, chapter 8, Arizona Revised Statutes, is amended by adding article 3, to read:
ARTICLE 3. SUPPLEMENTAL BENEFITS
38-1151. State death benefit; transitional housing benefit fund; definition
A. In addition to any other death benefit, if a law enforcement officer or firefighter is killed in the line of duty, this state shall pay to the decedent's surviving spouse or surviving dependent A transitional housing benefit payment that covers the cost of a residential mortgage loan or lease agreement for one year for a primary residence. the benefit payments may continue for up to one year and the monthly cost may not exceed $5,000. the benefit payments must be deposited into a third‑party managed escrow account.
B. The transitional housing benefit fund is established consisting of monies appropriated to the fund and monies received by the office of the governor from any lawful public or private source for this purpose. The office of the governor shall administer the fund. Monies in the fund are continuously appropriated. The office of the governor may accept and spend local, state and federal monies and private grants, gifts, contributions and devises to assist in carrying out the purposes of this section. Monies in the fund do not revert to the state general fund. Monies in the fund shall be used to pay the transitional housing benefit required by subsection A of this section.
C. For the purposes of this section, "Killed in the line of duty" means the decedent's death was the direct and proximate result of the performance of the decedent's duties and does not include suicide.
Sec. 2. Appropriation; transitional housing benefit fund; exemption
A. The sum of $500,000 is appropriated from the state general fund in fiscal year 2020-2021 to the transitional housing benefit fund established by section 38‑1151, Arizona Revised Statutes, as added by this act.
B. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
