AN ACT
amending Title
49, chapter 1, article 1, Arizona Revised Statutes, by adding section 49-119;
relating to the department of ENVIRONMENTAL quality.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 49, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 49-119, to read:
49-119. Energy efficiency
standards; rules; energy star; violation
A. The department shall adopt by rule
energy efficiency standards for products sold in this state. The rules shall be based on and at least as
stringent as the standards used in the energy star program adopted by the
United States environmental protection agency and the united states department
of energy. The rules shall include a
requirement that products sold in this state must be energy star approved
except for those categories of products for which there is no energy star
approved product.
B. On adoption of rules as prescribed
by this section, a person may not sell in this state a product that is not an
energy star approved product unless the product is of a type for which there is
no energy star approved product.
C. A person who sells a product in
violation of this section commits an unlawful practice under section 44-1522
and is subject to the remedies prescribed in title 44, chapter 10, article 7.
