AN ACT
amending section 41-1604.03, Arizona Revised Statutes; relating to the special services fund.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 41-1604.03, Arizona Revised Statutes, is amended to read:
41-1604.03. Special services fund; transfers; appropriations; uses; annual report
A. The special services fund is established in the state department of corrections. The department shall administer the fund.
B. The director shall transfer five hundred thousand dollars $500,000 from the special services fund annually to the department of corrections building renewal fund established by section 41‑797.
C. Of the monies remaining in the special services fund each fiscal year after the transfer required by subsection B of this section, the sum of $3,000,000 is appropriated from the special services fund each fiscal year to the state department of corrections for professional treatment programs and eligible services that are provided by licensed or certified professionals other than correctional officers, including:
1. Clinical social workers.
2. Therapists.
3. Psychiatric nurse practitioners.
4. Psychiatrists.
5. Psychologists.
6. Substance abuse counselors.
D. Any remaining monies in the special services fund after the transfer required by subsection B of this section and the appropriation made in subsection C of this section may be used for the following purposes:
1. The benefit, education and welfare of committed offenders.
2. To pay the costs of implementing, operating and maintaining technologies and programs for inmate use. Revenues that are generated by the inmate use of technology, including telephone systems, kiosks and tablets, shall be deposited in the special services fund.
E. Eligible services that may be provided pursuant to subsection C of this section include:
1. Cognitive behavioral therapy.
2. Group counseling.
3. Individual counseling.
4. Psychosocial interventions.
5. Post-traumatic stress disorder treatment.
6. Substance abuse and chemical dependency treatment.
7. Telemedicine.
C. F. On or before August 1 of each year, the department shall submit to the president of the senate and the speaker of the house of representatives a report that contains a full and complete account of special services fund transactions for the preceding fiscal year. The department shall transmit a copy of this report to the secretary of state.
