school marshals; requirements; training

Overview
Permits
a school district governing body, charter school governing body, community
college district governing body or private school (governing body) to appoint
an employee as a school marshal.
History
A person who knowingly possesses a deadly weapon on school grounds is
committing misconduct involving weapons, which can be punishable as a class 1
misdemeanor or a class 6 felony (A.R.S. § 13-3102
(A)(12) and (M)).
A district governing board is required to prescribe and enforce policies
and procedures that prohibit an individual from carrying or possessing a weapon
on school grounds unless the person is a peace officer or has obtained specific
authorization from the school administrator (A.R.S. § 15-341 (A)(23)).
Provisions
1. Allows
a governing body to appoint an employee as a school marshal if the employee
meets the requirements for licensure.
2. Stipulates that a governing body can
only appoint one school marshal for each 400 students per campus or, for each
campus, one school marshal for each school building in which students regularly
receive instruction.
3. Outlines the duties, responsibilities and
prohibitions of a school marshal.
4. Allows a school marshal to carry or
possess a handgun on the premises of a specific school and in a manner provided
by the written policies of a governing body.
5. Contains licensure requirements for an
employee to become a school marshal or renew a school marshal license and
requires the Department of Public Safety (DPS) to license or renew the employee.
6. Requires DPS or an approved DPS provider
to conduct the training of school marshals.
7. Outlines requirements for the training
program.
8. Mandates DPS to develop and administer a
psychological exam to each person (trainee) enrolled in the training program to
determine if the trainee is psychologically fit to carry out the duties of a
school marshal in an emergency.
9. Requires DPS to charge a training,
license and renewal fee as applicable.
10. Outlines requirements when DPS should
revoke an employee's school marshal license.
11. Mandates DPS to submit information of
each licensed school marshals to various individuals and entities and specifies
the information that is collected or submitted is confidential and not a public
record.
