HB 2040: abandoned vehicle fees

Overview

Sets the abandoned vehicle fees in statute rather than prescribed by administrative rule.

History

Pursuant to A.R.S. § 28-4802(A), the owner of record of a vehicle at the time of abandonment is liable to the Arizona Department of Transportation (ADOT) for the transfer of ownership or disposal in an amount prescribed by administrative rule if the vehicle was:

1)    Abandoned and junked on private property or public land or within the right-of-way of a street or highway;

2)    Abandoned on private property or public land or within the right-of-way of a street or highway and ADOT issues a transfer of ownership; or

3)    Abandoned, junked and towed with permission from state trust land within a city or town.

Pursuant to A.R.S. § 28-4802(B), the owner of record of a vehicle at the time of abandonment is liable to ADOT for the transfer of ownership or disposal in an amount prescribed by administrative rule if the vehicle was:

1)    Abandoned, junked and towed with permission off of national forest, state park, bureau of land management (BLM), or state trust land outside of a city or town;

2)    Abandoned and towed with permission off national forest, state park, bureau of land management (BLM), or state trust land outside the boundaries of an incorporated city or town and ADOT issues a transfer of ownership; or

3)    Abandoned outside the right-of-way of a street or highway outside of a city or town. 

17 A.A.C. 1, R17-1-205 prescribes the abandoned vehicle fees as follow:

1)    $500, if the vehicle was abandoned under A.R.S. § 28-4802(A); and

2)    $600, if the vehicle was abandoned under A.R.S. § 28-4802(B).

2.    Sets the abandoned vehicle fee at $200 rather than by administrative rule for a vehicle:

a)    On national forest, state park, BLM or state trust land outside a city or town; or

b)    Outside the right-of-way of a street or highway outside of a city or town. (Sec. 1)

3.    Makes technical changes. (Sec.1)
