HB 2103: defamation action; internet publications; accrual.

Overview

Prohibits libel or slanderous content form being posted to the internet. States the person who created the original publication on the internet is liable for damages to a person's reputation or character until the post is removed.

History

Currently, a person may be prosecuted within one year after the cause of action for the following actions:

1)    Malicious prosecution or false imprisonment;

2)    Damages for seduction or breach of promise of marriage;

3)    Breach of an oral or written employment contract;

4)    Wrongful termination; or

5)    Liability created by statute, other than penalty or forfeiture (A.R.S. § 12-541).

2.    Asserts that a person may make a claim for damages until the original publication is removed from the internet if  the publication causes injuries to a person's character or reputation. (Sec. 1)
