HB2107: school districts; minor boundary changes

Overview

Alters the requirements school district governing boards must meet when authorizing a minor boundary adjustment.

History

Minor boundary adjustments may occur if the school district governing boards of two adjacent common, union or unified school districts or the school district governing boards of a unified school district and adjacent common and union high school districts authorize a change in boundaries (A.R.S. § 15-460). Statute requires the following conditions to be true before any school district governing board can authorize a minor adjustment:

1)    None of the involved school districts have made more than one minor boundary adjustment previously;

2)    A majority of the electors within the geographic boundaries of a school district present a petition to the governing boards of the district or districts in which the petitioners currently reside and the district to which the petitioners desire to be annexed;

3)    A majority of the members of the governing boards of each district approve the minor boundary adjustment;

4)    The boundary adjustment would result in the transfer of not more than 1.5% of the student count of the district from which the students will transfer;

5)    The boundary adjustment would not result in the transfer in any school buildings, equipment or furnishings;

6)    No member of the school district governing board to be diminished is the resident of the territory that is being transferred; and

7)    The school district governing boards have agreed on a means to satisfy any liabilities.

a)    Removing the requirement that a majority of the electors within the geographic boundaries of a portion of a school district present a petition to the school district governing boards of the district or districts in which the petitioners currently reside and the district to which the petitioners wish to annex;

b)    Permitting a majority of the members of the governing boards of each district to unite in a petition to the county school superintendent for a minor boundary adjustment; and

c)    Allowing the boundary adjustment to result in the transfer of not more than 10% of the student count of the district from which the students will transfer. (Sec. 1)
