HB 2227: criminal justice commission; data collection

Overview
Requires criminal justice agencies to submit information or data to the Arizona Criminal Justice Commission (ACJC) and allows ACJC to establish guidelines for submitting and retaining the information or data.
History
ACJC facilitates information and data exchange among Arizona's criminal justice agencies.
ACJC is required to submit legislatively mandated reports, such as biennial criminal justice system reviews, supplemental reports, annual reports on law enforcement activities and annual recidivism reports. Currently, ACJC is granted the ability to request necessary information from local or state criminal justice agencies (A.R.S. § 41-2405).
Provisions
1. Requires state or local criminal justice agencies, unless prohibited by federal or state law, to submit any necessary information that is available or that can be collected without imposing significant burden or cost to ACJC. (Sec. 1)
2. Defines information as criminal justice information or data that is:
a) Useful in the study of crime and the criminal justice system;
b) Required to comply with legislatively mandated or requested reports;
c) Required for federal reporting; or
d) Deemed necessary by a full ACJC vote. (Sec. 1)
3. Allows ACJC to establish guidelines for submitting and retaining criminal justice information that:
a) Includes procedures for criminal justice agencies to transfer information or data;
b) Maintains the privacy and security of the information or data; and
c) Specifies conditions and agreements for the release of information or data that are consistent with maintaining the privacy and security of the information or data. (Sec. 1)
