HB 2340: autonomous vehicles; ADOT director's duties

Overview

Requires the director of the Arizona Department of Transportation (ADOT) to develop autonomous vehicle testing standards.

History

Laws 1973, Chapter 146 established ADOT to provide for an integrated and balanced state transportation system with a director responsible for the department's administration (A.R.S. § 28-331). ADOT has exclusive control and jurisdiction over state highways, state routes, state owned airports and all state- owned transportation systems or modes are vested in ADOT.

The duties of ADOT are as follows: 1) register motor vehicles and aircraft, license drivers, collect revenues, enforce motor vehicle and aviation statutes and perform related functions; 2) do multimodal state transportation planning, cooperate and coordinate transportation planning with local governments and establish an annually updated priority program of capital improvements for all transportation modes; 3) design and construct transportation facilities in accordance with a priority plan and maintain and operate state highways, state owned airports and state public transportation systems; 4) investigate new transportation systems and cooperate with and advise local governments concerning the development and operation of public transit systems; and 5) have administrative jurisdiction of transportation safety programs and implement them in accordance with applicable law (A.R.S. § 28-332).

Provisions

1.    Requires the director of ADOT to develop a standard for testing the operation of autonomous vehicles in Arizona including:

a)    A statewide training curriculum for:

i.      Operators of and passengers in autonomous vehicles relating to the limitations and benefits of autonomous vehicle technology; and

ii.     Emergency personnel's response to an autonomous vehicle emergency; and

b)    Privacy protections for a person in an autonomous vehicle to ensure that:

i.      Where the person travels in the autonomous vehicle is used only for aggregate purposes and not for identifying purposes; and

ii.     The person's personally identifying information is protected and the person may not be identified. (Sec. 1)

2.    Requires the director of ADOT to submit an annual report to the Governor, the President of the Senate, the Speaker of the House of Representatives and the Secretary of State. (Sec. 1)

3.    Requires the director of ADOT to include the following information in the report:

a)    ☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteThe number of vehicles being tested;  

b)    The number of vehicles being tested in Arizona on a closed course, in a testing site or on public roads; and

c)    The level of automation as described by a national society of automotive engineers. (Sec. 1)
