HB 2394: state aviation fund; purpose

Overview

Requires the Board of Transportation (BOT) to distribute appropriated State Aviation Fund monies according to the needs of publicly owned and operated facilities solely for purposes specified in law.

History

Laws 1995, Chapter 132 established the State Aviation Fund which consists of:

1)    Aviation or motor vehicle fuel taxes deposited by the Arizona Department of Transportation (ADOT);

2)    Monies deposited by ADOT as a result of the sale of an abandoned aircraft;

3)    The amount of flight property tax that the Arizona Department of Revenue (DOR) has deposited;

4)    Registration fees, license taxes and penalties collected for aircraft registration and taxation;

5)    Monies received from ADOT from the operation of airports; and

6)    The amount of jet fuel excise tax and jet fuel use tax that DOR has deposited. ADOT is required to administer monies that are appropriated by the legislature from the State Aviation Fund.

BOT must distribute appropriated monies for planning, design, development, acquisition of interests in land, construction and improvement of publicly owned and operated airport facilities in counties, incorporated cities and towns and Indian reservations. These monies are distributed according to needs of these facilities as determined by BOT. No more than 10% of the average annual revenue that the fund received for the past three years may be awarded to any one airport in grants in any fiscal year.

Publicly owned and operated facility is defined as an airport and appurtenant facilities in which one or more agencies, departments or instrumentalities of Arizona, a city town or county of Arizona or an Indian tribe or tribal government holds an interest in the land on which the airport is located that is clear of any reversionary interest, lien, easement, lease or other encumbrance that might preclude or interfere with the possession, use or control of the land for public airport purposes for a minimum period of 20 years (A.R.S. § 28-8202).
