Overview
Mandates that a marshal be appointed to each polling place for a nonpartisan election.
History
An election marshal is appointed by a county board of supervisors (BOS). The regular duties of a marshal include: preserving order at the polling place; making sure there is no violation of election laws; and measuring the length of the wait time at a polling place throughout the day and alerting the officer in charge of elections if it exceeds 30 minutes (A.R.S. § 16-535).
When a nonpartisan election is ordered, the governing board of the election must appoint, without considering political party, a minimum of three election workers for each polling place. The election workers must include at least one inspector and two judges (A.R.S. § 16-531).
Prior to an election, the BOS must conduct instruction classes for inspectors and judges of the election board related to their duties. Current statute specifies that only inspectors and judges of the election board who have received the instruction class will serve at any election (A.R.S. § 16-532).
Provisions
1. Adds a marshal to the election workers that must be appointed to each polling place for a nonpartisan election. (Sec. 1)
2. Includes a marshal to a board of elections for the tallying of votes if an electronic voting system is in use. (Sec. 1)
3. Specifies that an election marshal must also receive training not more than 45 days before an election. (Sec. 2)
4. Stipulates that marshals are included in members of the election board who serve at any election provided they have received the required instruction class. (Sec. 2)
5. Requires, rather than allows, the BOS to demand additional training for any or all election board workers. (Sec. 2)
6. Mandates that an election marshal be trained as outlined in statute and receive additional training provided by the Office of the Attorney General about election laws. (Sec. 3)
7. Asserts that an election marshal who receives the additional training is eligible to be a certified premium board worker. (Sec. 3)
8. Directs an election marshal that is a certified premium board worker to receive the additional training before each election in which they serve. (Sec. 3)
