Overview

Authorizes the Arizona Biomedical Research Centre to provide grants for marijuana research studies on the safety and efficacy of using marijuana for medical purposes.

History

In 2010, the Arizona Medical Marijuana Act (AMMA) was established through Proposition 203, a voter-approved initiative measure. Statute requires the Arizona Department of Health Services (DHS) to regulate the AMMA through rulemaking, registration and certification of medical marijuana dispensaries, registration of qualifying patients and designated caregivers, issuing or denying registry identification cards and establishing a verification system. Statute also outlines limitations of the AMMA, requirements for dispensaries, definitions of terms relating to the AMMA, guidelines on the dispensing of marijuana and the administration of the Medical Marijuana Fund (Fund). Provisions

1.    ☒ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteRequires the Arizona Biomedical Research Centre in DHS to provide competitive grants from monies in the Fund for marijuana research studies on the safety and efficacy of using medical marijuana, the public health implications of using medical marijuana and the impacts of marijuana interactions with prescription drugs. (Sec. 1)

2.    Requires that the study be conducted by Arizona-based researchers, be approved by an institutional review board and be publishable in peer-reviewed journals. (Sec. 1)

3.    States a person who receives a grant for a marijuana research study and any of the person's employees working on the research study may not be charged with or prosecuted for possession of marijuana that is cultivated for medical use when the person is working on the research study. (Sec. 1)

4.    Appropriates $5,000,000 from the Fund per year for five years to administer and award grants, and specifies that up to 5% of these monies may be used for administrative purposes. (Sec. 1)

5.    Allows monies in the Fund to be used to provide grants relating to marijuana research. (Sec. 2)

6.    Requires for enactment a three-quarters vote. (Sec. 3)
