Overview

Contains budget reconciliation provisions relating to the environment needed for implementing the FY 2021 budget.

History

The Arizona Legislature adopts a budget for each fiscal year (FY) that contains general appropriations. Article IV, Section 20, Part 2, Constitution of Arizona, requires the General Appropriations Act (feed bill) to contain only appropriations for the different state departments, state institutions, public schools and interest on public debt. Statutory changes necessary to reconcile the appropriations made in the feed bill and other changes are drafted into separate bills known as Budget Reconciliation Bills (BRBs). These BRBs are prepared according to subject area.

Provisions

Arizona Water Protection Fund Commission (Sec. 1)

1.    ☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteAuthorizes the Arizona Water Protection Fund Commission to grant up to $336,000 of the unobligated balance in the Arizona Water Protection Fund to the Arizona Department of Water Resources for administrative costs in FY 2021.

Underground Storage Tank Revolving Fund (Sec. 2)

2.    Allows the Arizona Department of Environmental Quality (ADEQ) to use up to $6,531,000 from the Underground Storage Tank Revolving Fund in FY 2021 for administrative costs and remediating sewage discharge issues in Naco and other Arizona border areas.

Arizona Navigable Stream Adjudication Commission (Sec. 3)

3.    Permits monies appropriated to the Arizona Navigable Stream Adjudication Commission from the Arizona Water Banking Fund to be used for legal fees in FY 2021.

Water Quality Assurance Revolving Fund (Sec. 4)

4.    Limits the appropriation from the state General Fund to the Water Quality Assurance Revolving Fund (WQARF) to $10,000,000 in FY 2021.

5.    Appropriates $4,922,200 from the following funds to WQARF in FY 2021:

a)    $2,779,900 from the Emissions Inspection Fund;

b)    $1,096,900 from the Air Quality Fund; and

c)    $1,045,400 from the Recycling Fund.

6.    Declares that the Legislature intends for the fund balances in the Emissions Inspection Fund, Air Quality Fund, and Recycling Fund to be evaluated to determine whether there are sufficient monies available to continue using these fund sources in FY 2022 for WQARF.

Vehicle Emissions Testing Fees (Sec. 5)

7.    Instructs the ADEQ Director to charge the same fees in FY 2021 that were charged in FY 2020 for emissions tests conducted in Area A (Maricopa County and portions of Pinal and Yavapai Counties).

a)    Exempts ADEQ from rulemaking requirements until July 1, 2021 to establish these fees.

Arizona Department of Water Resources (Sec. 6)

8.    Authorizes the Arizona Department of Water Resources (ADWR) Director to increase service fees in FY 2021.

a)    Requires monies received from these fees to be deposited in the Water Resources Fund.

b)    Declares that the Legislature intends that the fee monies generated not exceed $100,200.

c)    Exempts ADWR from rulemaking requirements until July 1, 2021 to establish these fees.
