SB 1073: athletic training board; fingerprinting; licensure

Overview

Requires licensed athletic trainers to possess a fingerprint clearance card.

History

Established in 2000, the Arizona Board of Athletic Training (Board) issues and renews licenses for the athletic training profession, receives and investigates complaints and takes disciplinary action when necessary.

Currently applicants for athletic training licensure must submit fingerprints to the Board to obtain a state and federal criminal records check. If an applicant possesses a valid fingerprint clearance card, the applicant may submit a copy of that document instead of fingerprints (A.R.S. § 32-4128).

Provisions

1.    ☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteRequires the executive director of the Board to send a reminder to a licensee at least 60 days before expiration of the license. (Sec. 1)

2.    Specifies a licensee is responsible for reporting a change in email address to the Board. (Sec. 1)

3.    Removes the requirement for a state and federal criminal record check and replaces it with a requirement for an applicant or a licensee to possess a valid fingerprint clearance card by January 1, 2021. (Sec. 2)

4.    Removes the appointment of hearing officers from the Board's investigative powers. (Sec. 3)

5.    Allows the Board to issue a non-disciplinary order requiring a licensee to complete a prescribed amount of continuing education if information received in a complaint does not merit direct action against the licensee. (Sec. 3)

6.    Adds athletic trainers to the fingerprinting statutes. (Sec. 4, 6 and 8)

7.    Repeals version 2 of the definitions relating to fingerprinting. (Sec. 5 and 7)

8.    Allows the Board to adopt or modify rules as necessary to carry out this act. (Sec. 9)

9.    Makes this act effective from and after December 31, 2020. (Sec. 10)

10.  Makes technical and conforming changes. (Sec. 2, 3, 4 and 6)
