SB1141: detention officers; arrest warrant; custody

Overview

Expands the ability in which a detention officer can arrest a person pursuant to an existing warrant.

History

A detention officer, acting in an official capacity, can arrest a person who is already incarcerated in or who surrenders to a jail facility at which the officer is employed if there is a warrant. Detention officer is defined as a person who is not an elected official but is employed by a county, city or town and is responsible for the supervision, protection, care, custody or control of inmates in a county or municipal correctional institution (A.R.S. § 13-3907).

Provisions

1.    Expands the ability in which a detention officer can arrest a person pursuant to an existing warrant if the person is either:

a)  At a hospital to which the detention officer is assigned, and the person being arrested is under law enforcement supervision or custody while in the facility;

b)  At a court facility to which the detention officer is assigned; or

c)  In a jail facility as a visitor when the person is found to have an outstanding warrant. (Sec. 1)

2.    Specifies the detention officer's ability to arrest a person must be pursuant to an arrest warrant. (Sec. 1)

3.    Enables a detention officer to take custody of a person who is remanded into custody by a judicial officer during a court proceeding while acting in official capacity. (Sec. 1)

4.    Makes technical and conforming changes. (Sec. 1)
