SB 1278: victims' privacy; criminal case information

Overview

Stipulates the location and identifying information of a victim must be redacted from records disclosed to the defense attorney or attorney's staff.

History

The originating agency and prosecution agencies must redact a victim's identifying and locating information that is obtained, compiled or reported by a law enforcement agency or prosecution agency from records about the criminal case involving the victim, including discovery disclosed to the defendant.

The current statute defines identifying information as including a victim's birth date, social security number and official state or government-issued driver license or identification number. Additionally, the location information includes the victim's address, phone number, e-mail and place of employment. (A.R.S. § 13-4434)
