SB 1300: mobile polling places; compliance

Overview

Specifies what statutory requirements apply to portable and mobile polling places.

History

Statute outlines the required conduct and procedures of a designated polling place. These requirements for polling places include:

1)    Following statutory requirements on the placement and operation of voting booths, ballot boxes and voting machines;

2)    Opening and closing the polling place at the correct times and in the correct way as described by statute;

3)    Provide alternative voting if a polling place is deemed inaccessible for elderly electors or electors with disabilities; and

4)    Not allowing any person inside the 75-foot limit surrounding the open polling place except for electors present for voting, election officials, one representative of each political party on the ballot and other exceptions specified by law (A.R.S. §§ 16-51516-565, 16-566, 16-570, 16-581).

The Americans with Disabilities Act of 1990 prohibits public entities from excluding or infringing any qualified individual in any way from participation in the benefits of services, programs or activities including voting (www.ada.gov).
