SB 1350: state parks; lottery; heritage fund

Overview
Requires $1,000,000 to be annually deposited into the Arizona State Parks Heritage Fund from the State Lottery Fund if monies are available after certain distributions are made.
History
State Lottery Fund Distributions
The State Lottery Fund is administered by the Arizona State Lottery Commission (Commission). This fund receives a certain percentage of annual revenues from lottery ticket sales or shares and instant games sales (A.R.S. §§ 5-555 and 5-571).
Statute prioritizes how fund monies will be distributed. First, monies will be used for debt service for revenue bonds and Commission expenses, then $10,000,000 will be deposited into the Arizona Game and Fish Commission Heritage Fund. However, this deposit will not be made if the State Lottery Director (Director) determines that $84,150,000 will not be available for the state General Fund. After making the deposit into the Arizona Game and Fish Commission Heritage Fund, statute prescribes additional distributions of fund monies (A.R.S. § 5-572).
Arizona State Parks Heritage Fund
The Arizona State Parks Heritage Fund was re-established in Laws 2019, Chapter 304. The Arizona State Parks Board administers this fund, which consists of legislative appropriations, grants, and donations (A.R.S. § 41-502). Fund monies are used for outdoor recreation and open spaces, historic preservation projects, non-motorized trails, and outdoor and environmental education (A.R.S. § 41-503). As of FY 2019, this fund has no monies (JLBC 2021 Baseline Book, p. 3/6).
Provisions
2. Prohibits the Director from depositing monies into the Arizona State Parks Board Heritage Fund until $84,150,000 is available in the state General Fund for that fiscal year. (Sec. 1)
3. Authorizes the Arizona State Parks Board Heritage Fund to consist of monies deposited from the State Lottery Fund and interest on those monies, among other monies. (Sec. 2)
4. Exempts the Arizona State Parks Board from rulemaking requirements for one year after the effective date of this act. (Sec. 3)
