SB 1503: school employees; pupils; electronic communications

Overview
Requires school districts, charter schools and the Arizona State Schools for the Deaf and the Blind to prescribe and enforce outlined policies and procedures on using electronic communications between school employees and pupils.
History
A person commits aggravated luring a minor for sexual exploitation if the person does both of the following: 1) Knowing the character and content of the depiction, uses an electronic communication device to transmit at least one visual depiction of material that is harmful to a minor; and 2) By means of the communication, offers or solicits sexual conduct with the minor. The offer or solicitation may occur before, contemporaneously with, after or as an integrated part of the transmission of the visual depiction (A.R.S. § 13-3560).
Provisions
Policies and Procedures for Electronic Communications (Sec. 1)
1. Restricts a school employee, a substitute teacher or a school employee volunteer to use only school technology platforms to directly engage in electronic communications with a student only for the purposes regarding academic and/or extracurricular activities.
a) Outlines persons exempt from the restriction.
2. Directs each school district governing board, charter school governing body and the Arizona State Schools for the Deaf and the Blind to prescribe and enforce policies and procedures on using electronic communications through school technology platforms.
a) Requires the policies procedures to be distributed to specified entities.
b) Outlines the contents of the policies and procedures.
3. Requires the policies and procedures be included in the school district's or school's student handbook.
4. Requires a parent to annually receive a written or electronic copy of the policies and procedures when the parent registers the pupil at the school district or school.
5. Instructs the State Board of Education to develop and post on their website a parental resource guide that includes information on how to file a complaint if the parent believes a school employee has violated the policies and procedures.
