statewide gaming; gaming devices
Purpose
Requires the Arizona Department of Gaming (ADG) to authorize, by rule, the operation of gaming devices in Arizona by any person the ADG licenses to conduct that activity.
Background
Arizona's Criminal Code prohibits promotion of gambling and benefiting from gambling, except for amusement gambling or regulated gambling (A.R.S. Title 13, Chapter 33). Regulated gambling is gambling conducted in accordance with: 1) an Arizona tribal-state gaming compact; or 2) Arizona or federal statute, rule or order for which all federal, state and local taxes, fees and charges in lieu of taxes have been paid (A.R.S. § 13-3301). A person who knowingly possesses, distributes or transports any implement, machine, paraphernalia equipment or other thing that the person knows or has reason to know is used or intended to be used in violation of Criminal Code Gambling statutes commits possession of a gambling device (A.R.S. § 13-3306).
The ADG monitors tribal gaming activities in accordance with the Arizona tribal-state gaming compacts, works in conjunction with the Arizona Racing Commission to regulate horse racing and provides staff support to the Boxing & Mixed Martial Arts Commission for the regulation of unarmed combat sports (A.R.S. Title 5, Chapters 1, 2 and 6).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires the ADG to adopt rules that allow the operation of gaming devices as regulated gambling in any location in Arizona and by any person licensed by the ADG to conduct that activity.
2. Requires the ADG rules authorizing the operation of gaming devices to include license application procedures and criteria for license approval, issuance, renewal and revocation.
3. Requires the Director of the ADG to establish fees for application, issuance and renewal of gaming licenses for the operation of gaming devices.
4. Makes technical changes.
5. Becomes effective on the general effective date.
