Purpose
Prohibits public records from being disclosed unless the requesting person has furnished their name, address, telephone number and email address to the public body.
Background
Permanent public records of the state or a county, city, town or other political subdivision must be transcribed or kept on durable material that conforms with standards established by the Director of the Arizona State Library, Archives and Public Records (A.R.S. § 39-101). Public records and other matters in the custody of any officer must be open for inspection by any person at all times during office hours (A.R.S. § 39-121). All officers and public bodies must maintain all records reasonably necessary or appropriate to maintain an accurate knowledge of official activities and of any activities which are supported by monies of the state or any political subdivision. Each public body must be responsible for the preservation, maintenance and care of that body's public records.
Any person may request to examine or receive copies or printouts of any public record. If requested, the custodian of the public records must also provide an index of public records that have been withheld and the reasons the records or categories of records have been withheld (A.R.S. § 39-121.01). Any person who has been denied access to public records may appeal the denial through a special action in superior court (A.R.S. § 39-121.02).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Prohibits a custodian of public records from disclosing a public record unless the requesting person has provided their name, address, telephone number and email address, if any, to the public body.
2. Makes technical and conforming changes.
3. Becomes effective on the general effective date.
