FACT SHEET FOR S.B. 1302

 

vehicle impoundment period

Purpose

            Decreases, from 30 days to 20 days, the mandatory vehicle impoundment period for certain specified violations.

Background

            A peace officer is currently required to cause the removal and immobilization or impoundment of the vehicle if the person operating the vehicle: 1) has their driving privilege revoked; 2) has never been issued a valid driver license or permit by Arizona or any other jurisdiction; 3) is subject to and is operating a vehicle without a functioning certified ignition interlock device; 4) is furthering the presence of an undocumented immigrant in Arizona or is concealing the detection of an undocumented immigrant; or 5) has displayed the vehicle for sale or transfer of ownership with a removed vehicle identification number (A.R.S. § 28-3511).

            A peace officer is also required to cause the removal and either immobilization or impoundment of a vehicle if the person driving the vehicle: 1) has a revoked license or has never been issued a license in Arizona or any other jurisdiction; 2) is not in compliance with the mandatory motor vehicle insurance requirements; and 3) is driving a vehicle that is involved in an accident that injured or killed another person. A vehicle that is impounded for any of the above reasons must be impounded for 30 days (A.R.S. § 28-3511).

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Decreases, from 30 days to 20 days, the mandatory impoundment period for a vehicle if the owner of that vehicle is in violation of:

a)      license and permit requirements;

b)      ignition interlock device requirements;

c)      furthering the presence of or concealing the detection of an undocumented immigrant;

d)      displaying the vehicle for sale or transfer of ownership with a removed or damaged vehicle identification number;

e)      driving a vehicle:

i.        with a revoked license;

ii.      not in compliance with mandatory motor vehicle insurance; and

iii.    that is involved in an accident involving injury or death; or

f)       laws relating to driving under the influence.

2.      Makes appropriate conforming changes to statute relating to mandatory impoundment period for vehicles.

3.      Makes technical changes.

4.      Becomes effective on the general effective date.
