SUBJECT:      Strike everything amendment to S.B. 1376, relating to defensive driving; rulemaking prohibition; repeal


 


Purpose

An emergency measure that repeals a temporary defensive driving rulemaking prohibition on the Arizona Supreme Court.

Background

Current statute requires a defensive driving school to submit a future schedule of classroom defensive driving courses to the Arizona Supreme Court, including dates, start and end times, instructor names and locations for each course. In order to be admitted into a class, a student must be registered with the defensive driving school offering the class. A defensive driving school instructor may only teach or facilitate one class during the same class instruction time period. The date, time or location of a class may not be changed or canceled except for extraordinary circumstances (A.R.S. § 28-3395).

            Laws 2019, Chapter 287 enacted session law that prohibits the Arizona Supreme Court from adopting or amending rules relating to defensive driving until July 1, 2020, unless an emergency necessitates the immediate adoption or amendment of a rule. Additionally, the Arizona Supreme Court is prohibited from conducting an efficacy study relating to defensive driving until July 1, 2020.

            There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.      Repeals session law that prohibits the Arizona Supreme Court from conducting an efficacy study or adopting or amending rules relating to defensive driving until from and after July 1, 2020.

2.      Becomes effective on signature of the Governor, if the emergency clause is enacted.
