FACT SHEET FOR H.B. 2243

 

appropriation; widening; Interstate 10

(NOW: appropriation; Gila River bridge)

Purpose

            Appropriates $28,000,000 from the state General Fund (state GF) in FY 2021 to the Arizona Department of Transportation (ADOT) to replace and expand the Gila River Bridge.

Background

            ADOT is responsible for the design and construction of state public transportation systems and the maintenance and operation of state highways in Arizona (A.R.S. § 28-332). ADOT is permitted to contract and do all things necessary to secure the full benefits available to Arizona for transportation purposes under federal law and, in doing so, ADOT is permitted to cooperate with: 1) federal, state and local government agencies; 2) Indian tribes; 3) private and public organizations; and 4) private individuals. ADOT is also permitted to exchange federal monies with local governments in order to receive local monies and is allowed to include additional federal monies in the exchange to offset the matching costs required of local governments (A.R.S.
§ 28-334
).

            The Gila River Bridge is located along the U.S. Interstate 10 in Pinal County and the Gila River Indian Reservation.

            H.B. 2243 appropriates $28,000,000 from the state GF in FY 2021 to ADOT.

Provisions

1.      Appropriates $28,000,000 from the state GF in FY 2021 to ADOT to replace and expand the Gila River Bridge.

2.      Prohibits the expenditure of the appropriation until the State Transportation Board adopts a five-year transportation plan that includes the Gila River Bridge project.

3.      Specifies that if the State Transportation Board does not adopt a program in FY 2021 with sufficient monies to fund the remainder of the Gila River Bridge project, the monies revert to the state GF on June 30, 2021.

4.      Exempts the appropriation from lapsing until the purpose for which the appropriation was made has been accomplished or abandoned, or if the monies remain unexpended or unencumbered for one full fiscal year.

5.      Exempts the appropriation from review by the Joint Committee on Capital Review.

6.      Becomes effective on the general effective date.
