AN ACT
Amending section
36‑1608, Arizona Revised Statutes; relating to fireworks.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 36-1608, Arizona Revised Statutes, is amended to read:
36-1608. Civil penalty; violation; classification
A. A person violating who violates a provision of this article is subject to a civil
penalty of one thousand dollars $1000. A person who uses fireworks as proscribed in section 36‑1601,
paragraph 7, subdivision (c):
1. for a first violation, is subject
to a civil penalty of $1,000.
2. For a second violation within
sixty months after the first violation, is subject to a civil penalty of
$2,000.
3. For a third violation within sixty
months after the first violation, is guilty of a class 3 misdemeanor.
B. A person who uses fireworks or permissible
consumer fireworks on preservation lands owned by a city or town that has purchased
more than fifteen thousand acres of land for preservation purposes is guilty of
a class 1 misdemeanor and shall pay a fine of at least one
thousand dollars $1,000.
