SENATE BILL 1418

 

 

 

AN ACT

 

amending sections 11-906, 11-909 and 41-835.02, arizona revised statutes; repealing sections 41-3020.04, 41-3020.05 and 41-3020.08, arizona revised statutes; amending title 41, chapter 27, article 2, arizona revised statutes, by adding sections 41-3028.04, 41-3028.05 and 41-3028.08; relating to the board of library examiners.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 11-906, Arizona Revised Statutes, is amended to read:

START_STATUTE11-906.  Board of library examiners; membership; compensation; powers and duties

A.  The board of library examiners shall consist consists of the director of the Arizona state library, archives and public records, who shall be is ex officio chairman, the librarian of the university of Arizona, the librarian of the Phoenix public library, and two county librarians who are appointed by the director of the Arizona state library, archives and public records and a position-at-large who is appointed by the director of the Arizona state library, archives and public records. The county librarian members shall serve one year three-year terms, and the director shall appoint the county librarian members on a rotating basis to represent each county free library.

B.  The members of the board shall are not eligible to receive no compensation for their services except actual and necessary travel expenses, which shall be paid from the general fund.

C.  The board shall pass upon on the qualifications of persons desiring to become county librarians and may, in writing, adopt rules not inconsistent with law for its government and to carry out the purposes of this article. END_STATUTE

Sec. 2.  Section 11-909, Arizona Revised Statutes, is amended to read:

START_STATUTE11-909.  General supervision; branch libraries; employees

A.  The county free library shall be under the general supervision of the board of supervisors, which may make general rules and regulations regarding the policy of the county free library, and establish, upon on recommendation of the county librarian, branches and stations throughout the county which that may be located in incorporated or unincorporated cities and towns when deemed advisable.

B.  The board may determine the number and kind of employees of the library, and may appoint and dismiss such employees upon on recommendation of the county librarian.  An employee shall not be removed except for cause, and in case a removal is made upon on the ground that the services of the employee are no longer required, the removed employee shall have the first right to be restored to employment when such services are again required, but the board may at the time of employing an employee, and upon on the recommendation of the county librarian, enter into an agreement that the employee be employed for a definite time only.

C.  All employees of the county free library whose duties require special training in library work shall be classified in grades to be established by the county librarian, with the advice and approval of the board of library examiners, according to the duties required of them, experience in library work and other qualifications for the service required.  Before appointment to a position in classified service, the candidate shall pass an examination appropriate to the position sought, satisfactory to the county librarian, and disclose a satisfactory experience in library work.  Work in approved library schools or libraries, or certificates issued by the board of library examiners, may be accepted by the county librarian in lieu of such examination.

D.  c.  The county librarian may accept as apprentices, without compensation, persons possessing personal qualifications satisfactory to him the county librarian and may dismiss them at any time if in his the county librarian's judgment their work is not satisfactory. END_STATUTE

Sec. 3.  Section 41-835.02, Arizona Revised Statutes, is amended to read:

START_STATUTE41-835.02.  State board on geographic and historic names; membership; expenses; quorum; staff support; chairperson

A.   The state board on geographic and historic names is established consisting of:

1.  One member appointed by the head of each of the following agencies or organizations:

(a)  The department of transportation.

(b)  The state land department.

(c)  The Arizona state library, archives and public records, who is a nonvoting advisory member.  The advisory member may not be considered for purposes of establishing a quorum.

(d)  The Arizona historical society.

(e)  The Arizona commerce authority.

(f)  The department of economic security.

(g)  A geography department of an Arizona university.

2.  Two three members of the public appointed by the governor, one of whom is a current or former elected tribal official.

B.  Members shall serve staggered five year five‑year terms to begin and end on the third Monday in January, except that the member appointed pursuant to subsection A, paragraph 1, subdivision (g) shall serve a two year two‑year term.  The initial appointment of the member appointed in subsection A, paragraph 1, subdivision (g) shall be made by Arizona state university.  On the expiration of the initial term of the member appointed in subsection A, paragraph 1, subdivision (g) the position shall be appointed by the university of Arizona, and on the expiration of that term northern Arizona university shall appoint the member.  The three state universities shall continue to rotate the appointment of this member on the board.

C.  Members are not eligible to receive compensation but are eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2.

D.  The Arizona state library, archives and public records shall provide staff support to the board.

E.  A majority of the members constitutes a quorum.

F.  The board shall annually elect a chairman chairperson and vice‑chairman vice chairperson from among its members. END_STATUTE

Sec. 4.  Repeal

Sections 41-3020.04, 41-3020.05 and 41-3020.08, Arizona Revised Statutes, are repealed.

Sec. 5.  Title 41, chapter 27, article 2, Arizona Revised Statutes, is amended by adding sections 41-3028.04, 41-3028.05 and 41-3028.08, to read:

START_STATUTE41-3028.04.  Arizona state library, archives and public records; termination July 1, 2028

A.  the arizona state library, archives and public records terminates on july 1, 2028.

b.  Title 41, chapter 1, article 2.1 and this section are repealed on january 1, 2029.END_STATUTE

START_STATUTE41-3028.05.  State board on geographic and historic names; termination July 1, 2028

A.  the state board on GEOGRAPHIC and historic names terminates on july 1, 2028.

b.  Title 41, chapter 4.1, article 3 and this section are repealed on january 1, 2029. END_STATUTE

START_STATUTE41-3028.08.  Board of library examiners; termination July 1, 2028

A.  the board of library examiners terminates on july 1, 2028.

b.  section 11-906 and this section are repealed on January 1, 2029.END_STATUTE

Sec. 6.  Purpose

Pursuant to section 41-2955, subsection B, Arizona Revised Statutes, the legislature continues the Arizona state library, archives and public records to provide library, archives and public records services to the public.

Sec. 7.  Purpose

Pursuant to section 41-2955, subsection B, Arizona Revised Statutes, the legislature continues the state board on geographic and historic names to ensure that the historical record of this state is protected and preserved.

Sec. 8.  Purpose

Pursuant to section 41-2955, subsection B, Arizona Revised Statutes, the legislature continues the board of library examiners to pass on the qualifications of persons desiring to become county librarians.

Sec. 9.  Retroactivity

Sections 4 and 5 of this act apply retroactively to from and after July 1, 2020.
