AN ACT

 

amending Title 16, chapter 4, article 1, Arizona Revised Statutes, by adding section 16-410.01; relating to conduct of elections.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 16, chapter 4, article 1, Arizona Revised Statutes, is amended by adding section 16-410.01, to read:

START_STATUTE16-410.01.  Election observers; access; notice

A.  In addition to OTHERWISE applicable laws relating to election observers, election observers may view all stages of the ELECTION process, including the maintenance and organization of the voter registration rolls and the chain of custody of ballots beginning with ballot design through completion of the canvass.

B.  Election observers may document observations and ask questions of election officers and shall receive timely responses.  Election observers are guaranteed the right to have uniform and NONDISCRIMINATORY access pursuant to this section.

C.  Election observers shall register with the officer in charge of elections and state their intent to observe and the location to observe not later than 10:00 a.m. on the day immediately preceding the day on which the stage of the election occurs as prescribed by subsection A of this section.
