AN ACT
amending sections 12‑281 and 41‑1903, Arizona Revised Statutes; relating to superior court clerks.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Section 12-281, Arizona Revised Statutes, is amended to read:
12-281. Oath; bond; salary; prohibition
A. The clerk of the superior court shall take the oath of office and give a bond in the sum of five thousand dollars $5,000 conditioned upon on the faithful performance of the duties of that office and the payment of all monies to the person entitled to receive them. The bond is subject to approval by the presiding superior court judge.
B. In counties having a population of five hundred thousand or more persons, as determined by the latest preceding federal decennial census, the annual salary of the clerk of the superior court is seventy‑six thousand six hundred dollars until modified seventy percent of the salary of a superior court judge.
C. In counties having a population of less than five hundred thousand persons, as determined by the latest preceding federal decennial census, the annual salary of the clerk of the superior court is sixty‑three thousand eight hundred dollars until modified sixty percent of the salary of a superior court judge.
D. The annual salary of the clerk of the superior court shall be reviewed by the commission on salaries for elective state officers pursuant to section 41‑1903.
E. D. The clerk of the superior court and the clerk's deputies are prohibited from practicing law or forming a partnership with an attorney‑at‑law. This subsection does not prohibit the clerk or the clerk's employees from providing to the public, including litigants, information regarding documents routinely filed with the clerk.
Sec. 2. Section 41-1903, Arizona Revised Statutes, is amended to read:
41-1903. Function
A. Beginning in 2002, the commission shall biennially conduct a review of the rates of pay of elective state officers, and of justices and judges of courts of record and of clerks of the superior court. Such The review by the commission shall be made for the purpose of determining and providing the pay levels appropriate to the duties and responsibilities of the respective offices and positions subject to such the review. The commission may hold public hearings to aid it in its work.
B. The commission shall submit to the governor no not later than June 1 a report of the results of each review conducted by the commission of the offices and positions subject to this chapter, together with its recommendations.
Sec. 3. Effective date
This act is effective from and after December 31, 2022.
