AN ACT
amending Title 41, chapter 4.1, article 4, Arizona Revised Statutes, by adding section 41-847; amending Title 41, chapter 27, article 2, Arizona Revised Statutes, by adding section 41-3022.17; relating to Archaeology.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 41, chapter 4.1, article 4, Arizona Revised Statutes, is amended by adding section 41-847, to read:
41-847. Archaeology advisory commission; members; terms; qualifications; meetings; compensation; purposes; annual report
A. The archaeology advisory commission is established consisting of fifteen members appointed by the governor for three year terms.
B. Each member shall have a demonstrated interest or expertise in one or more of the fields of prehistoric archaeology, historic archaeology, anthropology, ethnology, tourism, public education, economic development or planning. At least eight of the members shall have a demonstrated interest or expertise in one or more of the fields of prehistoric archaeology, historic archaeology, ethnology or anthropology. One member shall be a rancher, one member shall be a tribal member and one member shall be a member of a natural resource conservation district organized under title 37, chapter 6.
C. The commission shall annually select one of its members as chairperson and shall meet at such times as the majority of the members designates.
D. Members of the commission are not eligible to receive compensation or reimbursement of expenses, except that those members employed by this state are eligible for reimbursement of expenses pursuant to title 38, chapter 4, article 2 by the department or agency by which they are employed.
E. The commission shall advise the state historic preservation officer in:
1. Conducting public education programs to promote archaeology and inform the public on archaeological issues.
2. Fostering archaeological law enforcement activities to stop pothunting and other destructive activities on archaeological sites.
3. Providing for the development of a state plan for protection of archaeological sites, including acquisition and development.
4. Developing mechanisms to assist private owners of archaeological sites in protecting and managing their sites.
5. Fostering continued study of this state's archaeology to contribute to a better understanding of our cultural history.
6. Archaeological activities and issues within this state.
F. The commission shall submit an annual report regarding its activities to the governor, the president of the senate and the speaker of the house of representatives.
Sec. 2. Title 41, chapter 27, article 2, Arizona Revised Statutes, is amended by adding section 41-3022.17, to read:
41-3022.17. Archaeology advisory commission; termination July 1, 2022
A. The archaeology advisory commission terminates on July 1, 2022.
B. SEction 41-847 and this section are repealed on January 1, 2023.
Sec. 3. Purpose
Pursuant to section 41-2955, subsection E, Arizona Revised Statutes, the legislature establishes the archaeology advisory commission to aid the state historic preservation officer by providing expert advice in the areas of archaeological education, protection of archaeological sites and archaeological activities and issues of this state.
