AN ACT

relating to funding for students who receive instruction through a distance learning plan.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Public schools; funding; fiscal year 2020-2021

Notwithstanding Executive Orders 2020-41 and 2020-51 and any other law, for fiscal year 2020-2021, students who receive instruction through a distance learning plan submitted pursuant to Executive Order 2020-41:

1.  Shall be funded at the same amount as students receiving in‑person instruction under title 15, chapter 9, Arizona Revised Statutes.

2.  May not be funded as students receiving Arizona online instruction under section 15-808, Arizona Revised Statutes.

Sec. 2.  Retroactivity

This act applies retroactively to from and after June 30, 2020.

Sec. 3.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
